A public officer or employee who does any of the following, for which no other sentence is specifically provided by law, may be sentenced to imprisonment for not more than 364 days or to payment of a fine of not more than $3,000, or both:

(1) intentionally fails or refuses to perform a known mandatory, non-discretionary, ministerial duty of the office or employment within the time or in the manner required by law; or

(2) in the capacity of such officer or employee, does an act knowing it is in excess of lawful authority or knowing it is forbidden by law to be done in that capacity; or

(3) under pretense or color of official authority intentionally and unlawfully injures another in the other's person, property, or rights; or

(4) in the capacity of such officer or employee, makes a return, certificate, official report, or other like document having knowledge it is false in any material respect.

"Thank you for your email inquiry seeking answers to questions from the city as opposed to seeking the production of municipal data. The city is not in possession of any data that would contain answers to your below questions. The city is unable to provide answers to your questions. The city would refer you to the county for data

that may contain answers to your questions. Thank you for your inquiry."

The City's VERY POOR, IRRESPONSIBLE RESPONSE,To My

MARCH 29, 2024 Letter To HAMBURG MAYOR CHRIS LUND,

was RECEIVED A DAY AFTER, I sent my SECOND

LETTER To LUND On MAY 29, 2024 !!

"The City does not have a responsibility to simply

answer all questions as you have posed them in your correspondence dated March 29, 2024, unless the answer to the questions can be found in municipal data. “Government data” does not include unrecorded mental impression of government employees or city council members. Keezer v. Spickard, 493 N.W.2d 614 (Minn. Ct. App. 1993). As stated by the Court of Appeals, “we cannot believe the legislature intended the term ‘government data,’ to be literally interpreted to include unrecorded data that exists only in a human brain. Interpreting ‘government data’ to include mental impressions formed by public employees during the course of employment would lead to absurd results.” 493 N.W.2d at 617. The City provides the following responses as to your questions contained within your March 29, 2024, correspondence to the City."

My requests for PUBLIC INFORMATION were then followed by .......

"Response: The City is not interpreting your question to be data practices act request and therefore is not providing a response to the above question. Your question is also vague and ambiguously drafted."

But, unknown to me at the time, that would all change and the individual that I first perceived to be the 'warm and welcoming' representative of the CITY OF HAMBURG, turned out to be a HUGE disappointment, actually; I would PERSONALLY find out that he was really 'A Wolf in Sheep's Clothing' !!"

"Gruenhagen is one of just a very few times in my life that I 'misjudged' somebody. In my view, he's a real 'fooler' and was a BIG disappointment to me !! Some of his actions were so EGREGIOUS after I became a City Councilmember (2013-2017) and since, I'm devoting an ENTIRE SECTION of this book to, and about, him."

"Even his staunchest 'supporters', other than 'similar' City Officials, (birds of a feather syndrome) will be surprised, dismayed and disappointed when they learn more, little known information, about him, his 'quick temper', mood swings and some of the things he's done; acts that he has committed."

"As a Hamburg City Councilmember, I witnessed it all !! But the City kept 'covering' for him and 'sweeping everything under the concrete slab' on which the City Hall sits. And their STILL DOING IT YET TODAY; why do you think the 'Deputy' City Clerk of EIGHT YEARS abruptly quit and WHY the CITY OF HAMBURG can't hire a replacement Public Works employee ?"

"It's crystal clear that because of Gruenhagen's reputation, nobody wants to work in the 'hostile work environment' that he creates. Again; I witnessed it FIRSTHAND, while I was on the City Council. I vividly recall one time when Gruenhagen went on a 'tirade' about the then Fire Chief Brad Droege and spoke poorly about him."

Born In 1943, I Am Now A Retired Law Enforcement

Officer Whose Career Began in 1966.

In addition to attaining the rank of Sergeant with the MAPLE PLAIN (Minnesota) POLICE DEPARTMENT (now WEST HENNEPIN DEPARTMENT OF PUBLIC SAFETY), I joined the HENNEPIN COUNTY SHERIFF'S OFFICE (Minnesota's Largest Sheriff's Office) in October 1969 as a Senior Deputy Sheriff and attained the rank of Sergeant in both the RADIO/COMMUNICATIONS DIVISION as well as in the WARRANT/FUGITIVE DIVISION.

While continuously maintaining a valid MINNESOTA POLICE OFFICER STANDARDS & TRAINING BOARD (P.O.S.T.) License until it's expiration in 1997, I retired from the Sheriff's Office in September 1984. I am also a former EMERGENCY MEDICAL TECHNICIAN (E.M.T.) and a UNITED STATES AIR FORCE FIRE PROTECTION SPECIALIST.

In 2012, I was elected to a four year term on the HAMBURG (Minnesota) CITY COUNCIL, I currently host THREE Websites as well as a regularly scheduled hour long, five times a week Internet Show and a series of Internet Programs that primarily feature current & retired Law Enforcement and other Public Safety Officials.
